BODELL,

with claims presented under the Pennsylvania Workers' Compensation
Act. We represent our clients throughout the state, defending employee
Claim Petitions, Fatal Claim Petitions and Reinstatement Petitions,
as well as prosecuting Petitions to Terminate, Modify and Suspend
Compensation Benefits.
The
Pennsylvania Workers' Compensation Act underwent sweeping changes
throughout the 1990s. In 1993 the Pennsylvania legislature enacted
Act 44, which amended the Pennsylvania Workers' Compensation Act
and provided effective medical cost containment legislation. The
medical cost of a Workers' Compensation claim has decreased dramatically
since the enactment of Act 44. In 1995 the legislature passed Act
I, which has very effectively reduced the cost of claims presented
for occupational noise induced hearing loss. In 1996 the legislature
enacted Act 57, which streamlined methods for modifying from total
to partial disability compensation and provided offsets to the employer
for unemployment compensation, social security retirement benefits,
severance pay, and certain types of pension payments. Act 57 also
reformed the method by which average weekly wage is calculated and
in many cases reduced the total disability and partial disability
compensation rates.
Workers'
Compensation is a highly technical area of the law, comprised of
statute, Bureau regulation and decisional case law. This is an area
of the law where there is certainly no substitute for experience.
